The short version
- Use the site lawfully and respectfully; don't attack it, spam it or post harmful content.
- Information on the site, including Kao's answers, is general guidance. A project only becomes binding when we both sign a written agreement.
- Our content, code and brand belong to us; your comments stay yours, but you let us show them.
- Dashboard accounts are by invitation only, must be kept secure, and activity is logged.
- Kenyan law applies. We'll always try to settle any disagreement by talking first.
1. Agreement to these terms
These terms are an agreement between you and Kikao Systems Group Limited ("Kikao Systems", "we", "us"). By using kikaosystems.co.ke ("the website") or the Kikao dashboard, you accept them. If you use the site for a company, you confirm you may accept them for that company. If you don't agree, please don't use the site. Our Privacy Policy explains how we handle personal data and forms part of these terms.
2. Using the website
You may browse, read and share links to our content for personal or business use. You agree not to:
- break any law, or infringe anyone's rights, while using the site;
- try to gain unauthorised access to the site, the dashboard, our servers or other people's accounts, or test our security without our written permission;
- send spam, malware, automated or bulk requests, or anything that overloads or disrupts the site;
- scrape or copy large parts of the site, or use it to train AI models, without our written permission;
- pretend to be someone else or give false information in our forms.
We use bot checks, rate limits and other safeguards, and may block access that breaks these rules.
Found a security problem? Please tell us privately at info@kikaosystems.co.ke instead of exploiting or publishing it. We'll thank you and fix it.
3. Comments, chat and what you send us
You are responsible for comments, chat messages and anything else you send. Please don't post anything that is unlawful, defamatory, hateful, harassing, misleading, someone else's private information, spam or advertising. We may edit, hide or remove any comment, and block anyone who repeatedly breaks these rules.
You keep ownership of what you write. By posting a comment you give us a free, non-exclusive, worldwide licence to display it with the article, and to remove it whenever we choose. Comments are the opinions of their authors, not of Kikao Systems.
4. Kao and AI-generated answers
Kao, our chat assistant, gives instant answers from our own information and uses AI for other questions. AI answers can be incomplete or wrong. They are general information, not professional advice and not an offer. Prices, timelines and scope are only confirmed in a written quote from our team. Ask for a person at any time.
5. Quotes and project requests
- Sending a Get Started request, contact message or chat enquiry does not create a contract or oblige either of us to go ahead.
- Any price on the website or given informally is an estimate. A quote is valid for the period it states (30 days if none is stated).
- Every project is governed by a separate written agreement or proposal signed by both sides, covering scope, price, payment, delivery and ownership. That agreement prevails over these terms if they conflict.
- Portfolio and case studies show past work; results for your project depend on its own circumstances.
6. Intellectual property
The website, its design, text, graphics, logos, code and the Kikao name and brand belong to Kikao Systems or our licensors. You may not copy, change, sell or reuse them without our written permission, except to share links or short quotes with a credit to us. Third-party names and logos shown on the site belong to their owners and appear only to identify their products or our clients.
7. Third-party services and links
The site uses and links to services run by others, for example Google, Cloudflare, WhatsApp, LinkedIn, TikTok, Facebook, Instagram and X. Their own terms and privacy policies apply when you use them, and we are not responsible for their content or availability.
8. Dashboard user terms
These extra terms apply to staff and invited team members who use the Kikao dashboard.
Access
- Accounts are by invitation only and personal to you; never share your account, password, codes or passkeys.
- You must set up a second sign-in step and keep your sign-in methods and backup codes safe.
- You may only use the modules and actions your administrator has given you, and only for Kikao Systems business.
Confidentiality and data protection
- Messages, project requests, client details, drafts, analytics and anything else in the dashboard are confidential. Don't copy them out of the dashboard or share them except as your work requires.
- Handle personal data only as our Privacy Policy and Kenya's Data Protection Act allow.
- Report a lost device, suspicious sign-in alert or suspected leak straight away. The "This wasn't me" button in sign-in alerts locks your account at once.
Acceptable use
- Publish to our blog and social accounts only what is accurate, lawful and approved under the dashboard's approval rules.
- Don't try to reach modules you haven't been given, get around security features, or use AI tools in the dashboard to create misleading or unlawful content.
Monitoring and suspension
- For security and accountability we record sign-ins (time, IP address, approximate location, device), active sessions, and actions taken in the dashboard (the audit log). Administrators can see these records.
- We may change your permissions, sign you out, lock or suspend your account at any time to protect the business or its clients, for example after suspicious activity, a policy breach, or when your role ends.
- When your engagement ends, your access is removed and you must not keep copies of dashboard data.
9. Disclaimers
We work to keep the website accurate and available, but it is provided "as is" and "as available". We don't promise it will always be error-free, uninterrupted or free of harmful components, or that its content is complete or current. Nothing in these terms limits any right you have under the Consumer Protection Act, 2012 or other law that cannot be excluded.
10. Limitation of liability
To the extent the law allows, Kikao Systems is not liable for indirect or consequential loss, or for loss of profit, revenue, data or goodwill, arising from your use of the website, its content, Kao's answers or third-party services. Our total liability to you in connection with the website is limited to KES 10,000. This doesn't limit liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't allow us to limit. Liability for paid projects is set out in the project agreement.
11. Indemnity
If you break these terms or the law while using the site, and that causes a claim against us, you agree to cover our reasonable losses and costs from that claim.
12. Governing law and disputes
These terms are governed by the laws of Kenya. If a disagreement arises, please contact us first and we will try in good faith to settle it within 30 days. If that fails, either side may refer it to mediation in Nairobi and, failing that, to the courts of Kenya, which have jurisdiction. If you are a consumer living elsewhere, you keep any protection your local law gives you.
13. Changes to these terms
We may update these terms as our services or the law change. The version and effective date are at the top; continuing to use the site after a change means you accept the new terms. We'll e-mail dashboard users about important changes. If any part of these terms is found unenforceable, the rest still applies.
What changed in version 2.0: rewritten in plain language, adding rules for comments and the Kao chat assistant, the dashboard user terms, quotes and projects, and dispute resolution.
